Triton Marine Charter Services - Terms and Conditions Form

General : Triton Marine Charter Services undertakes to transport divers/passengers to and from te agreed site(s), and to provide standard safety equipment and facilities. Triton Marine does not undertake to provide advice regarding dive planning or recommendations relating to scuba diving practices. It is the individual responsibility of divers to dive within the limits of their own training and experience.
Safety : The final decision regarding the safety of the vessel, its crew and those on board rests with the Skipper. The final decision relating to the suitability of the weather for sailing or diving operations will be made by the Skipper, whose decision shall be final and binding. The skipper may cancel or amend the trip at any time if he believes the conditions are, or are likely to become unsuitable for the proposed charter.
Insurance : Triton Explorer is fully insured to carry 12 passengers on board. Our insurance does not cover passengers who are away from the vessel whilst engaged in diving or other water sports or activities. Triton Marine Charter Services accepts no liability for loss or damage to personal property including diving equipment and any equipment left on the boat overnight is expressly left at the owner's risk.
Deposit : Deposit The deposit as detailed on the booking form, will be paid in full at the time of booking. Credit cards are accepted. All Cheques should be made payable to Triton Marine Charter Services.
Payment of Balance : It is Triton Marine Charter Services responsibility to ensure that the balance, as detailed on the booking form, is paid in full, before or on the day of the charter prior to departure. Payment may be made in cash or credit card to Triton Marine before departure or by cheque made payable to Triton Marine Charter Services 10 working days before the day of charter.
Booking : Booking Triton Explorer is not considered booked until the completed Booking Form and agreed deposit has been received. Provisional bookings by phone, fax or e-mail will be held for seven days pending receipt of the Booking Form and deposit. Every person making a booking for or on behalf of a club or group warrants and confirms that he/she has the authority of those individual(s) on behalf of whom the booking is made and that each person agrees to be bound by these conditions. It is the responsibility of the individual booking the charter to ensure that all members of the group are familiar with these terms and conditions which shall apply to the booking.
Diving Charters : Diving charters Divers chartering Triton Explorer shall provide sufficient instructors and/or other competent persons to supervise all diving activities and use of diving equipment and shall be fully responsible therefore. Triton Marine Charter Services and its crew shall not be responsible for any accident or injury caused to any person or persons arising out of diving or use of any equipment. It is the diver’s responsibility to ensure that the dive sites chosen by them are suitable for the members of their group given their current level of training, experience and fitness. The Charter Party shall be responsible for ensuring compliance with all matters arising from the Merchant Shipping Act, the Protection of Wrecks Act and any legislation regarding the laws of salvage.
Changes To Proposed Itinerary : Triton Marine Charter Services reserves the right to cancel or amend the scheduled charter in any way considered desirable due, in its sole and absolute discretion, to adverse weather or any other conditions. Triton Marine Charter Services also reserves the right to alter published prices in accordance with any major changes in cost which Triton Marine Charter Services may occur between the time of booking and the time of departure.
Cancellation Policy : In the event of a customer cancellation Triton Marine Charter Services will make every effort to resell the charter and will refund money paid less any expenses incurred. If the charter is unable to be re-sold, the following shall apply:
If cancelled More than ten weeks prior to charter - full refund. Within four to ten weeks prior to charter - loss of deposit paid. Within two to four weeks prior to charter – loss of deposit and 50% refund of balance monies paid. Less than two weeks - no refund applicable.
If owing to circumstances beyond the control of Triton Marine Charter Services the charter is cancelled by them, or any other party acting as agent for them, a full refund of monies paid will be given.
